Welcome to Canvas Monarch. These Creator Terms & Conditions (“Terms”) govern the relationship between Canvas Monarch (“Platform,” “we,” “us”) and represented living artists (“Creator,” “Artist,” “you”). By submitting an application or listing physical artwork on Canvas Monarch, you agree to these Terms.
1. Originality & Ownership Rights
1.1 100% Original Physical Masterworks: You declare and warrant that all submitted and listed physical artworks are 100% original physical paintings created solely by your hand.
1.2 Copyright Retention: The Creator retains full intellectual property rights, copyright, and reproduction rights to the artwork. Canvas Monarch is granted a non-exclusive license to display high-resolution digital representations of the artwork solely for cataloging, marketing, and sales promotion.
1.3 Anti-Replica Policy: Canvas Monarch enforces a strict zero-tolerance policy against physical counterfeits, digital reproductions, or AI-generated works masquerading as original hand-painted canvases.
1.4 Creator Warranty & Full Indemnification: The Artist explicitly warrants that all artwork metadata, dimensions, mediums, creation dates, and originality claims provided to Canvas Monarch are 100% accurate and truthful. In the event of any false declaration, physical misrepresentation, or copyright dispute, the Artist agrees to indemnify, defend, and hold harmless Canvas Monarch, its directors, and platform operators from all legal claims, collector refunds, court fees, and financial damages.
2. Flexible Pricing, Strategic Listing & Promotional Discounts
2.1 Artist Agreed Base Valuation: You set the minimum agreed target value for your physical masterwork (e.g., $50,000 USD).
2.2 Dynamic Listing & Promotional Discretion: To drive high-ticket collector conversions, run VIP salon promotions, and offer exclusive patron coupon codes, Canvas Monarch reserves the right to list the public catalog price above your base valuation (e.g., listing a $50,000 artwork at $60,000).
2.3 Upside Profit-Sharing & Realized Sale Split:
- Platform commission (5% introductory / 10% standard) is always calculated on the actual final realized sale price paid by the collector after all discounts or coupon codes are applied.
- If promotional marketing results in a final sale price higher than your initial agreed valuation (e.g., selling at
$55,000instead of$50,000), 100% of the extra profit split flows directly to you. The 10% platform fee applies to$55,000(Platform fee:$5,500), and you receive the remaining 90% ( $49,500 ) directly.

3. Primary Sales & Settlement
3.1 Sovereign Payout Splits:
- First Sale (Founding Offer): Creator retains 95% of the realized sale price (5% platform fee).
- Ongoing Sales: Creator retains 90% of the realized sale price (10% platform fee).
3.2 Nodal Escrow Settlement: Collector payments are secured in a neutral nodal escrow account during shipping and released directly to your bank account immediately following the 48-Hour Physical Inspection Period upon delivery.
4. Artist-Managed Shipping & Fulfillment
4.1 Direct Studio Dispatch: Delivery and packaging of the physical artwork are handled directly by the Artist/Studio. Canvas Monarch does not provide physical freight, packing, or courier transport services.
4.2 Packaging Standards & Insurance: The Artist agrees to package physical canvases in accordance with museum-grade archival standards and dispatch shipments via tracked, signature-required couriers with adequate transit insurance.
4.3 Tracking Submission: The Artist must upload valid courier tracking details to the Canvas Monarch portal upon dispatch to initiate the collector’s 48-hour delivery inspection window.
5. Secondary Market Resale Royalties
5.1 Automated Resale Royalty: Canvas Monarch is dedicated to long-term creator equity. Every time your physical painting is resold between collectors on the Canvas Monarch Secondary Exchange, an automated 10% royalty of the total resale price will be remitted directly to you.
5.2 Provenance Tracking: Resale royalties are tracked and governed via the physical painting’s unique Serial ID and tamper-evident hardware tag.
6. Hardware Authentication & NFC Tagging

6.1 Silicon Frame Intelligence: Every physical artwork listed on Canvas Monarch must be fitted with an integrated, factory-encoded silicon NFC frame chip and paired with an official Certificate of Authenticity (COA) bearing a unique Serial ID.
6.2 Tagging Protocols: Creators agree to embed provided NFC frame tags into custom frame structures prior to dispatch.
7. Non-Exclusivity & Catalog Freedom
7.1 Non-Exclusive Representation: Representation on Canvas Monarch is non-exclusive unless otherwise agreed upon in writing. You retain full freedom to sell other works independently or through physical gallery partners.
7.2 Work Availability: You agree to maintain accurate availability status. If a piece is sold through an external channel, you must de-list or reserve it on Canvas Monarch within 24 hours.
