1. Catalog Acquisitions & VIP Patron Access
1.1 Direct Acquisitions: All prices displayed on the public catalog or checkout page represent the final acquisition price for 100% direct physical ownership.
1.2 24-Hour VIP Early Access: Registered Sovereign Patrons opting into VIP access receive a 24-hour priority acquisition window on newly listed masterworks prior to public catalog release, alongside invitations to Canvas Monarch’s offline physical gallery exhibitions.
2. Hardware Authenticity & Artist Declarations
2.1 100% Original Physical Masterworks: All listed physical canvases are verified as 100% original hand-painted physical works created directly by represented living artists.
2.2 Silicon NFC Frame Verification: Every physical canvas features an embedded, tamper-evident silicon NFC frame chip paired with an official Certificate of Authenticity (COA) bearing a unique Serial ID, allowing instant smartphone verification of provenance.
2.3 Sole Creator Liability & Legal Indemnification Disclaimer: All metadata, physical dimensions, medium descriptions, provenance records, and claims of 100% originality are executed under sworn legal warranty solely and exclusively by the represented artist. Canvas Monarch operates strictly as a technology infrastructure provider and neutral escrow venue. Canvas Monarch assumes no independent warranty or verification liability for creator declarations. Canvas Monarch disclaims all liability for misrepresentations, forgeries, false statements, or intellectual property disputes. Following the settlement of the 48-hour escrow inspection window, Canvas Monarch is fully released from all claims, and any subsequent legal recourse, damages, or dispute proceedings must be initiated directly by the collector against the declaring artist.
3. The 48-Hour Physical Escrow Inspection Window
3.1 Secure Escrow Deposit: Upon checkout, collector funds are deposited directly into a neutral nodal escrow account prior to courier dispatch.
3.2 Physical Inspection Period: Upon courier delivery confirmation (signature required), a 48-hour physical inspection window automatically begins. This window allows the collector to inspect the physical canvas in person to confirm condition, dimensions, and hardware NFC authenticity.
3.3 Finality of Sale: Once the 48-hour inspection window expires without a formal transit damage or discrepancy claim submitted through the platform, escrow funds automatically settle to the artist. At this point, the sale becomes final, non-refundable, and unappealable.
4. Transit Damage & Escrow Claims
4.1 Reporting Transit Damage: In the rare event a physical artwork arrives damaged during transit or exhibits severe physical discrepancies from the declared listing:
- The collector must document the issue with clear photos/videos of both the external packaging and the physical canvas.
- The claim must be submitted to support@canvasmonarch.com within the active 48-hour inspection window. 4.2 Escrow Pause: Submitting a verified claim within the 48-hour window immediately pauses the escrow countdown, preventing payment release while our team reviews the claim.
5. Return Eligibility & Logistics
5.1 Non-Returnable Masterworks: Due to the bespoke, high-value nature of original physical paintings, returns or refunds are not accepted for change of mind, aesthetic preference shifts, or failure to inspect artwork details prior to acquisition. 5.2 Authorized Returns (Transit Damage / Verification Claims): If a return is authorized by Canvas Monarch following a verified claim:
- The artwork must be repacked in its original archival packaging.
- Return transport must be executed via an approved, fully insured fine-art courier with signature required upon delivery back to the artist’s studio.
- Once the artist confirms physical receipt and inspection, escrowed funds are refunded to the collector’s original payment method.
